Shaq

I'm sure by now you all are aware that Atlanta has filed a restraining order against basketball legend Shaquille O'Neal. And I bet some of you are probably wondering how in the hell can one obtain a restraining order when Fulton County doesn't even offer them, right? Well allow me to break down the ways of Fulton County.

According to the SOHH news department some chick named Alexis Miller is alleging that Shaq is stalking her, blah, blah, blah. After going down to the Fulton County Courthouse and speaking with the judge an alleged restraining order was granted.

But allow me to educate you on how Fulton County works fellas. Hopefully this will prevent you from getting caught up in some girl's evil retaliations.

Fulton County does not grant restraining orders. They are called Temporary Protective Orders [TPO] which can be turned into a Permanent Protective Order. A temporary protective order (TPO) is a court order to help protect you from someone who is abusing, threatening or harassing you. The order will require the abuser to stay away from you, your home and your work. The abuser will be prohibited from contacting you in any way.

But what you might also not know is that ANYONE can obtain this order. There's no real guideline as to who can obtain an order against another. If your story is convincing enough to the judge they will grant you a TPO until both parties report to court on a specified date and the judge can hear both sides and determine if a PPO [Permanent Protective Order] is necessary.

Once you report to court you will have to have proof of abuse, threats made against, harassment, etc. If you can't produce any evidence to back up your story then your case is dismissed and the TPO is canceled. However, until your schedule court date you are legally required to follow the terms of the TPO or risk going to jail.

But again, the disturbing thing about Fulton County is how they allow anyone to file often times bogus TPO's in the first place.

One time I had an argument with a former male roommate back when I first moved to Atlanta four years and decided to move out. After relocating to a new address this nucca decides he wants to get ugly and go down to the courthouse and claim harassment. His TPO was granted and I was ordered to stay away from him or any places he frequented for two weeks until we went to court. Of course when we went to court he couldn't prove any of the allegations and the case was dismissed. But the whole ordeal was an experience that I would never want to go through again.

Now mind you once a TPO is granted whatever your normal routine is [gym, grocery stores, clubs, events,] if that person is within 200 yards of it you can't be there. Most people pull that bitch card to capture a moment of power. But it just blows my mind that a county would allow such things to occur.

In NYC if you want a restraining order [note, most states don't even offer TPO's] then you better come to the courthouse with some fresh bruises, pictures, threatening voicemails….you know EVIDENCE before you'd even get considered to file any paperwork.

SOHH For everyone who moves to the ATL in search of a great job, girls and prosperity you might want to take into consideration that there are a lot of sneaky conniving b*tches and b*tchassness fellas who might have you in court, and possibly in jail over some bullsh*t.

I believe Alexis Miller to be nothing more than a sneaky distrustful opportunist who is trying to make a name for herself. I bet any amount of money that when Sept 4th rolls around this TPO will be dismissed.

Too bad for Shaq that he's got to be here. Another thing that sux about Fulton County is their demand that you attend your court cases. Unfortunately your lawyer can not  appear on your behalf.

Talk to y'all lata,

This wouldn't have happened to him if had of not been cheating on his wife in the first place. Shaq brought this on himself.

Lol I can hear it now.....

And u know athletes caint stay faithful.its normal 2 break a skeeza off every now and then.

Realtalk is a mad angry woman. But I feel you Gyant, although the reality is that the cops and women get together quite often to make the life of some of us hell. I have 'seen' a woman go with no proof and straight up lie to the police and the guy she was lying about got arrested for stalking! Women in America are evil and poisonous, for the most part. And you know Shaunie was riding some horse when Shaq was hitting Ms. Miller.

1. 4 Million women are violently abused by men they know each year.

2. A restraining order, or its equal, in v various states provides a speedy and easy way to protect women who are usually controlled emotionally, socially, physically and financially.

3. If the process were too difficult the number of deaths attributed to domestic violence would increase dramatically.

4. A man relaying a story about another man that got a restraining order against you? SMH. That sounds suspect AND even if it was difficult, its not nearly as bad as having a woman hunted like a dog and having a husband or boyfriend threaten to kill you or mame her. So check yourself.

5. Shaq doesn't even live in Atlanta. So he ought to be fine, unless he intends on harming the sister. In the meantime, the TPO establishes a possible motive, which keeps her alive and unharmed, even by 3rd party individuals.

6. She does appear to be a "celebrity hopper", but that doesn't mean that Shaq didn't threaten her and it doesn't mean she needs to be left to defend herself. IF she exhorted him, it will surface. IF he threatened her, it will surface. But in the meantime, everyone is alive and breathing. Which is more than we can say for your blog, which is dieing a slow death.

In my state, we have TRO(Temporary Restraining Order),which is basically the same process as TPO. Both parties must show up in court and present their supporting evidence. The judge ultimately decides whether to make it a permanent restraining order.
Although many TPO's/TRO's are valid and necessary,Gyant you are right- anyone can get one based(on one-sided)evidence.

This should be a lesson learned for Shaq. Miss Miller wanted more than he was willing to give.

@TheSponsor

Thank you.

This TPO thing is good/bad. It can be helpful in such cases but doesn't work in others. If there is a diagreement between two people. It's a race to see who can inconvience the other faster.

Gyant says: One more time and I will ban you IP address. It's up to you.
